Terms of Service

1. Acceptance of Terms

By creating an account or using venq ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use venq. These terms apply to all users, including free, beta, Founding Maker, and paid subscribers.

2. Description of Service

venq is a subscription-based market management platform that helps independent vendors, artists, and makers track market events, manage applications, and analyze sales performance. Features vary by subscription plan.

3. Accounts

• You must provide accurate information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account with others or create accounts on behalf of someone else without their consent.
• You must be at least 18 years old to use venq.
• Organization owners are responsible for the actions of all team members they invite. Each member must agree to these Terms before accessing the Service.

4. Subscription Plans & Billing

venq offers the following plans:

• Starter (Free): Limited events and applications. No credit card required.
• Maker ($9/mo): Unlimited events and applications for solo vendors.
• Pro ($19/mo): All Maker features plus team seats, POS integration, and advanced analytics.
• Founding Maker ($9/mo): Full Pro-level access at a locked-in rate. Limited to the first 50 subscribers. See Section 5.

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize venq to charge your payment method on a recurring basis. Prices are subject to change with 30 days notice, except for Founding Maker subscribers whose rate is locked in per Section 5.

6. Cancellation & Refunds

You may cancel your subscription at any time through the Billing section in your account settings. Cancellation takes effect at the end of your current billing period. You retain access until then.

We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us at support@govenq.com within 7 days of the charge.

7. Your Data

You own the data you enter into venq. Your market events, applications, sales figures, and business information remain yours. We do not claim ownership of your content. You grant us a limited license to store and process your data solely to provide the Service.

You may export your data at any time using the export features in the app. Upon account deletion, your data will be removed from our systems within 30 days.

If you connect a third-party point-of-sale system (such as Square or Shopify), you authorize venq to access your sales data from that service solely to provide the Service to you. We do not share, sell, or use this data for any purpose beyond powering your venq account.

8. Acceptable Use

You agree not to:

• Use venq for any unlawful purpose or in violation of these terms.
• Attempt to gain unauthorized access to any part of the Service.
• Reverse engineer, copy, or resell any part of the platform.
• Upload harmful, fraudulent, or misleading content.
• Use the platform in a way that disrupts other users or our infrastructure.

9. Disclaimer of Warranties

venq is provided "as is" without warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. The financial insights and analytics in venq are informational only and do not constitute financial or business advice.

10. Limitation of Liability

To the fullest extent permitted by law, venq and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data, loss of revenue, or business interruption. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms, engage in fraudulent activity, or misuse the Service. You may also delete your account at any time from your account settings.

12. Governing Law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts. venq is operated by KallenCo, a Wyoming company.

13. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of venq after changes take effect constitutes your acceptance.
